1. Purpose:
The purpose of this policy is to establish clear guidelines and procedures for identifying, documenting, and rejecting fake trading cards to safeguard the reputation of ENCASEIFY and to preserve the credibility of cards within the collectible trading card ecosystem. Please note this policy does not apply to custom cards.
2. Definitions:
Fake Card: Fake trading cards are intentionally produced to mimic genuine cards in order to deceive collectors, buyers, or players into thinking they are authentic and valuable. These fakes are often manufactured to replicate the appearance, design, and attributes of real trading cards, including the characters, artwork, and text.
Custom card: Custom trading cards are cards that have been created by fans or artists for personal use, artistic expression, or as a hobby. These cards are not meant to deceive or replicate the appearance of genuine trading cards for fraudulent purposes. Custom cards are often unique creations that reimagined existing or showcase original artwork.
3. Submission Requirements and Responsibilities:
Customers submitting cards for encapsulating must ensure that the cards are authentic, unaltered, and meet our submission guidelines.
Submitters are responsible for the accuracy of information provided about the cards’ origin, history, and provenance.
4. Rigorous Authentication Process:
Our team of expert employs cutting edge technology, historical knowledge, cross referencing with a database of known counterfeit cards, and analytical techniques including discrepancies in printing methods, materials, and design.
5. Rejection Protocol:
If a submitted card is identified as fake, it will be immediately disqualified from encapsulating.
The submitter will be notified in a timely manner, accompanied by detailed documentation outlining the specific reasons for rejection.
6. Non-Acceptance Fee:
A non-refundable non-acceptance fee, outlined in our fee schedule, will be charged for each rejected fake card. This fee covers the cost of authentication efforts and ensures fairness to all submitters.
7. Zero Tolerance for Fraud:
Deliberately submitting counterfeit cards is considered a violation of our terms of service and will not be tolerated.
ENCASEIFY reserves the right to take appropriate legal action against individuals or entities found guilty of submitting fake cards.
8. Return of Fake Cards:
Upon request, fake cards that have been rejected will be returned to the submitter at their own expense. Customers will need to pay an administration fee for the fake card to be shipped back. ENCASEIFY will not be held responsible for any further use or distribution of the fake cards.
9. Confidentiality:
All information related to the identification and rejection of fake cards will be handled confidentially and used only for internal purposes.
10. Policy Review:
This policy will be reviewed periodically to ensure its effectiveness and alignment with industry best practices.
11. Custom Labels:
All custom cards encapsulated will include a text ‘CUSTOM’ displaying on the card label.
12. Public Communication:
This policy will be made accessible on our website to inform submitters, collectors, and stakeholders about our commitment to authenticity.
